A Vacation Rental Booking Brand of VYBE Realty Group Inc., d/b/a VYBE Hawaii
Status: Version 3.0 — approved terms for new rate-plan reservations. New requests are available only after coordinated payment activation.
Applicability: New reservations accepted under version 3.0 after coordinated payment activation. Existing reservations retain their accepted policies and original payment schedules.
By requesting, confirming, or completing a reservation through VYBE Premier Rentals, the primary guest (“Guest”) acknowledges and agrees to these Terms & Conditions, the applicable property-specific House Rules, the Cancellation Policy disclosed at booking, and any additional terms expressly accepted during the reservation process.
These Terms establish the rights and responsibilities of the Guest and VYBE Premier Rentals in connection with the reservation and use of the booked property.
1. Company Identity and Third-Party Booking Platform
VYBE Premier Rentals is a vacation rental booking brand of VYBE Realty Group Inc., doing business as VYBE Hawaii (collectively referred to as “VYBE,” “VYBE Premier Rentals,” “we,” “us,” or “our”).
VYBE Premier Rentals operates an online platform facilitating short-term vacation rental reservations for independently owned properties located in Honolulu, Hawaii.
VYBE acts as a third-party booking intermediary between Guests and participating property owners. Unless expressly stated otherwise, VYBE does not own the individual properties listed on the platform.
Property ownership, building operations, maintenance obligations, and guest services may involve the applicable property owner, property management representatives, condominium associations, building operators, and other independent service providers.
VYBE’s responsibilities are determined by the services it actually provides, its contractual obligations, and applicable law. Nothing in these Terms excludes liability that cannot legally be excluded.
2. Reservations and Booking Confirmation
All reservations are subject to property availability, accurate Guest information, applicable booking requirements, and successful payment authorization or collection.
Submitting a booking request does not guarantee a reservation.
A reservation becomes confirmed only after the required payment authorization or charge succeeds, availability has been verified, and VYBE issues a booking confirmation.
Guests must provide accurate contact information, the correct number of occupants, and any information reasonably required to process their reservation.
VYBE may decline a booking request for legitimate reasons, including unavailable inventory, payment failure, inaccurate reservation information, or failure to satisfy applicable booking requirements, consistent with applicable law.
3. Payments and Payment Authorization
All prices are quoted in United States dollars unless otherwise specified.
The reservation total may include accommodation charges, cleaning fees, applicable taxes, and other charges clearly disclosed before booking.
Payments are processed securely through third-party payment providers, including Stripe.
The full reservation amount is authorized after staff approval using direct charges through the assigned property owner’s connected payment account. For new reservations under this version, Flexible Rate payment capture is scheduled after the eligible twenty-four (24) hour complimentary cancellation window. Where no complimentary window applies, Flexible Rate capture is initiated immediately after verified authorization and confirmation. Nonrefundable Rate capture is initiated immediately after successful verified authorization and confirmation. Bank processing may take additional time. A cancellation entitlement and a payment capture deadline are distinct; an uncaptured authorization does not create an additional complimentary cancellation period. These payment rules are staged and will not take effect until completed payment verification and coordinated activation. Existing reservations retain their original payment schedules.
An eligible full cancellation before capture releases the uncaptured authorization. After capture, refunds follow the accepted cancellation policy and require staff approval before processing through the original payment account. If a cancellation with a partial or nonrefundable retention entitlement is received before a pending capture completes, settlement may capture only the accepted retained amount and release any remaining authorization, subject to staff review, applicable law and payment-network requirements. No additional charge or refund occurs automatically because a cancellation is requested. Uncertain payment outcomes require reconciliation before further money movement.
An authorization temporarily reserves funds on the Guest’s payment method and is not necessarily an immediately captured charge.
Guests authorize the collection of amounts expressly disclosed and agreed to during booking.
Additional charges for damage, excessive cleaning, approved services, or other incidentals require a valid contractual and payment authorization and must comply with applicable law and payment-network requirements.
A prior reservation payment does not, by itself, authorize unlimited future charges.
4. Rate Plans and Cancellation Policies
The selected rate plan and its cancellation policy are disclosed before a booking request is submitted and recorded with the accepted pricing and policy version. Both rate plans are governed by this single agreement; no separate rate-plan agreement is required. Flexible Rate is the default. These approved policies govern new reservations accepted under version 3.0 after coordinated payment activation. Previously confirmed reservations retain their accepted terms.
Flexible Rate
Flexible Rate uses the final globally adjusted nightly price without an additional rate-plan discount.
Reservations booked more than seven (7) full days before the scheduled check-in time qualify for a twenty-four (24) hour complimentary cancellation period after successful payment authorization and reservation confirmation. Both events must have occurred; the period begins at the later of their verified timestamps. Eligibility is determined at that timestamp, not when the booking request is submitted. Exactly seven days before arrival does not qualify.
The eligible 24-hour cancellation period takes precedence over the standard tiers below, even if a tier boundary is crossed during that period. Cancellation received before the exact 24-hour deadline receives a 100% refund of amounts collected or release of any uncaptured authorization, as applicable. At the deadline, the standard tiers apply.
Outside the eligible complimentary period, or where no complimentary period applies:
- Thirty (30) or more full days before scheduled check-in: 100% refund.
- Seven (7) full days or more, but less than thirty (30) full days before scheduled check-in: 50% refund.
- Less than seven (7) full days before scheduled check-in: nonrefundable.
Nonrefundable Rate
Nonrefundable Rate applies an additional five percent (5%) discount to final Flexible nightly accommodation charges only. Cleaning fees, extra-guest fees and other fixed charges are not discounted by this rate plan; applicable taxes are recalculated on the resulting taxable charges. The rate and accepted discount are recorded with the reservation.
There is no complimentary cancellation period. The reservation is confirmed and nonrefundable immediately after successful payment authorization has been verified and VYBE records confirmation, except where a refund is required by applicable law or VYBE or the property owner cancels the reservation. Payment capture is initiated immediately at that time under the new payment workflow described in Section 3. Refund processing requires staff approval; mandatory refund rights remain intact.
Exact Hawaii Standard Time Deadlines and Cancellation Receipt
All deadlines use exact timestamps in Hawaii Standard Time (HST, UTC−10 year-round), not rounded calendar-day differences. Check-in is scheduled for 3:00 PM HST unless the accepted reservation specifies otherwise. The 30-day and 7-day deadlines are exactly 720 and 168 hours, respectively, before scheduled check-in. At exactly 30 days, the 100% tier applies; at exactly 7 days, the 50% tier applies. The complimentary deadline is exactly 24 elapsed hours after the later verified authorization/confirmation timestamp.
Guests request cancellation by phone or SMS/text. Eligibility uses the time VYBE receives the request, not the time staff processes it. Staff review and process any release or refund through the reservation’s original payment account; no automatic incidental charge or additional cancellation charge is authorized by this section.
If VYBE or the property owner cancels a confirmed reservation, the Guest receives a full refund of amounts collected for that reservation or release of any uncaptured authorization, as applicable. Mandatory legal refund rights apply to both rate plans. Released authorizations may remain visible temporarily depending on the Guest’s financial institution.
Changes to a reservation are subject to approval and do not automatically restart a complimentary cancellation period. The accepted rate plan, discount, pricing, agreement version and cancellation-policy snapshot govern that reservation; later settings or policy edits do not retroactively change them.
5. Check-In and Check-Out
Standard check-in time is 3:00 PM Hawaii Standard Time.
Standard checkout time is 11:00 AM Hawaii Standard Time.
Early check-in and late checkout are subject to availability and prior approval.
Unauthorized late checkout may result in reasonable additional charges where disclosed and permitted by law.
Guests must follow the arrival, access, and departure instructions provided for their property.
6. Pre-Arrival Registration and Identification
Guests may be required to complete pre-arrival registration and provide valid government-issued identification before receiving property access information.
Identification requirements will be disclosed and administered in accordance with applicable law.
Guests must provide accurate information and cooperate with reasonable identity verification procedures.
Personal information and identification documents must be collected and handled through appropriate secure methods and in accordance with the applicable Privacy Policy.
The primary Guest must review and electronically sign this Guest Agreement as part of the required Pre-Arrival Registration process.
Failure to complete lawful and previously disclosed registration and signature requirements may delay or prevent access to the property.
7. Occupancy and Registered Guests
The number of occupants may not exceed the maximum occupancy disclosed for the property.
Only authorized Guests and approved visitors may occupy or use the premises in accordance with the property rules.
Unauthorized subletting, commercial use, events, and parties are prohibited unless expressly approved in writing.
Guests are responsible for the conduct of their accompanying occupants and invitees.
Material occupancy violations may result in additional documented charges or termination of the stay where legally permitted.
8. House Rules and Guest Conduct
Guests agree to comply with all applicable property rules, condominium or building regulations, posted notices, and lawful safety instructions.
Guests must behave respectfully toward neighbors, other occupants, building personnel, and service providers.
Quiet hours generally apply from 10:00 PM to 7:00 AM, or as otherwise specified by the applicable property or building.
Prohibited conduct includes:
- Excessive noise and disturbances
- Harassment or threatening behavior
- Illegal activity
- Unauthorized parties or gatherings
- Deliberate property damage
- Unsafe or improper use of amenities
- Material violations of building regulations
Serious violations may result in termination of the stay, removal through lawful procedures, and applicable charges or remedies.
9. Guest Responsibility for Property Damage
Guests are responsible for damage, loss, excessive cleaning, and other recoverable costs resulting from their own actions or those of their occupants and invitees, excluding ordinary wear and tear.
Recoverable charges may include:
- Repair or replacement of damaged property
- Missing furniture, appliances, or household items
- Restoration labor and materials
- Excessive cleaning
- Smoking or odor remediation
- Damage to building facilities caused by the Guest
- Lost or damaged keys, access devices, and parking passes
- Reasonable and documented loss of rental income directly attributable to Guest-caused damage, where legally recoverable
Charges must be reasonable, supported by appropriate documentation, and consistent with applicable law.
VYBE or the applicable property representative may provide an itemized damage statement and supporting evidence.
Guests remain responsible for qualifying damages even when no security deposit is collected.
10. Card on File and Incidentals
VYBE Premier Rentals does not collect a security deposit or place an incidental/security-deposit hold on the Guest’s card. The separate reservation-payment authorization described in Section 3 is not a security deposit.
During pre-arrival registration, each Guest saves a payment card securely with Stripe as the card on file for the stay. Saving the card is not a charge, hold, or authorization, and no automatic or scheduled charge is ever made to it. Registration cannot be completed until Stripe successfully verifies and saves a valid card through VYBE Realty Group Inc.’s own Stripe account, separate from accommodation payments through the assigned property owner’s connected account. Historical saved cards and payments remain on their original accounts. The Guest must explicitly accept this card-on-file consent. Any payment requiring additional bank authentication must complete that authentication before funds are collected.
If documented incidentals — such as damage, missing items, or excessive cleaning — are identified, VYBE staff may charge the card on file only after documented review and approval, only within fourteen (14) days after the Guest’s checkout, and only in accordance with this Agreement, the Guest’s recorded consent, applicable law, and payment-provider requirements.
The card on file does not limit a Guest’s responsibility for additional legally recoverable damage.
VYBE or the applicable property owner may also pursue documented damage claims through other lawful and properly authorized means.
11. Smoking, Vaping, and Odors
Smoking and vaping are prohibited inside all properties designated as nonsmoking.
This includes cigarettes, electronic cigarettes, vaping devices, and other smoking products.
Guests are responsible for reasonable, documented cleaning and restoration costs arising from violations.
Property-specific smoking rules, including balcony and common-area restrictions, must be observed.
12. Pets and Animals
Pets are permitted only in properties that expressly allow them and subject to applicable property rules.
Unauthorized pets may result in lawful cleaning charges, damage claims, or other permitted remedies.
Nothing in these Terms limits rights relating to assistance animals under applicable law.
13. Assumption of Risk
Guests acknowledge that use of vacation rental properties and related facilities involves ordinary risks.
These may include:
- Slips, trips, and falls
- Stairways, elevators, and balconies
- Swimming pools and recreational facilities
- Fitness equipment
- Parking areas
- Appliances and household equipment
- Ocean, beach, and outdoor activities
- Weather and environmental conditions
- Facilities operated by third parties
Guests agree to exercise reasonable care, supervise minors and accompanying occupants, follow safety instructions, and use facilities only as intended.
To the fullest extent permitted by applicable law, Guests voluntarily assume ordinary and inherent risks associated with their use of the property and amenities, except to the extent such risks arise from conduct for which liability cannot lawfully be excluded.
14. Release of Liability and Limitation of Claims
To the fullest extent permitted by applicable law, the Guest releases VYBE Realty Group Inc., doing business as VYBE Hawaii, VYBE Premier Rentals, the applicable property owner, and their respective employees, agents, and authorized representatives (collectively, the “Protected Parties”) from claims for personal injury, property damage, loss, or inconvenience arising from ordinary risks of the Guest’s use of the premises and amenities, including ordinary negligence only to the extent a release of such negligence is enforceable under applicable law.
This release does not apply to gross negligence, reckless or intentional misconduct, fraud, statutory violations, or any other conduct or claim for which liability cannot legally be waived.
Nothing in this agreement prevents a Guest from asserting rights or pursuing remedies that cannot lawfully be restricted.
15. Indemnification and Hold Harmless
To the fullest extent permitted by applicable law, Guests agree to indemnify and hold harmless the Protected Parties from reasonable third-party claims, liabilities, damages, and expenses arising from:
- The Guest’s negligent or wrongful conduct
- Actions of the Guest’s occupants or invitees
- Guest-caused damage
- Material violations of these Terms
- Unauthorized or unlawful use of the property
This obligation does not require Guests to indemnify any Protected Party for that party’s own negligence, misconduct, or legal violations to the extent prohibited by law.
Any duty to defend and any recovery of legal expenses shall apply only where legally enforceable.
16. Personal Belongings and Lost Property
Guests are responsible for securing their personal belongings.
VYBE and the applicable property owner are not insurers of personal property brought onto the premises.
Responsibility for lost, stolen, or damaged belongings is limited to the extent permitted by applicable law.
Property-specific lost-and-found procedures may apply.
Reasonable shipping and handling costs may be charged for returning recovered items with the Guest’s authorization.
17. Building Amenities and Third-Party Services
Amenities such as pools, gyms, elevators, parking facilities, laundry rooms, security systems, and recreational areas may be operated by independent building associations or third-party service providers.
Availability may change because of maintenance, repairs, weather, safety requirements, or building decisions.
VYBE does not guarantee uninterrupted availability of amenities controlled by third parties.
Nothing in this section excuses inaccurate material listing descriptions or legal responsibilities that cannot be disclaimed.
18. Parking and Vehicle Responsibility
Parking is available only where expressly included or authorized.
Guests must follow all assigned-space requirements, building regulations, posted restrictions, and parking instructions.
Unauthorized or improperly parked vehicles may be subject to lawful citation or towing at the vehicle owner’s expense.
Guests are responsible for violations attributable to their vehicles.
VYBE and the applicable property owner are not responsible for vehicle loss or damage except to the extent liability is imposed by applicable law.
19. Keys, Access Devices, and Parking Passes
Guests must return all issued keys, access fobs, access cards, and parking passes according to the property’s checkout instructions.
Lost, damaged, or unreturned items may result in reasonable replacement charges based on the applicable property’s disclosed fee schedule.
Guests may not duplicate access devices or share access codes with unauthorized individuals.
20. Housekeeping and Property Condition
Unless expressly advertised otherwise, vacation rentals are self-service accommodations.
Mid-stay housekeeping is not automatically included.
Additional cleaning or housekeeping services may be available for an additional disclosed fee.
Guests must maintain reasonable cleanliness and leave the property in acceptable condition, excluding ordinary wear and tear.
Excessive cleaning beyond normal turnover may result in reasonable documented charges.
21. Surveillance and Security
Certain properties and buildings may use video surveillance in exterior areas, entrances, parking facilities, or common areas for legitimate security purposes.
Applicable surveillance must be disclosed as required by law.
VYBE does not authorize undisclosed surveillance in private guest living areas.
Guests must not disable, tamper with, or interfere with lawful building security equipment.
22. Internet and Technology Services
Internet access may be provided as an amenity.
Guests must not use internet services for unlawful activities, unauthorized access, or conduct that materially interferes with service availability.
Internet speed, connectivity, and availability may vary.
Temporary outages may occur.
23. Alcohol, Drugs, and Illegal Activity
Guests must comply with all applicable laws relating to alcohol, controlled substances, and public conduct.
Illegal activity, threatening conduct, and dangerous behavior are prohibited.
Management may take lawful action in response to serious violations, including contacting appropriate authorities.
24. Force Majeure and Service Interruptions
Events beyond reasonable control may affect the availability or use of the property.
Examples include:
- Hurricanes and severe weather
- Natural disasters
- Government orders
- Public emergencies
- Utility interruptions
- Building closures
- Labor disruptions
- Transportation interruptions
The parties’ rights and obligations in these circumstances are subject to the applicable reservation terms and governing law.
Nothing in this section eliminates rights or remedies that cannot lawfully be excluded.
25. Right to Refuse Service or Terminate a Stay
VYBE or the applicable property representative may refuse or terminate a reservation for lawful and legitimate reasons, including:
- Material violations of property rules
- Serious safety threats
- Fraudulent booking information
- Unauthorized occupancy
- Illegal conduct
- Failure to satisfy disclosed payment requirements
Any removal, cancellation, or retention of payment must comply with applicable law and the terms accepted at booking.
This provision does not authorize discriminatory treatment or unlawful eviction.
26. Guest Reviews and Feedback
Guests are welcome to provide honest reviews and feedback regarding their experience.
VYBE may dispute statements that are demonstrably false or unlawful through appropriate legal or platform procedures.
Nothing in these Terms prohibits honest negative reviews or restricts consumer rights protected by law.
27. Modifications and Reservation Changes
Reservation modifications are subject to property availability, applicable rates, and approval.
Changes to dates, occupancy, or property selection may result in revised pricing.
A modification does not automatically restart an expired free cancellation period.
Any material changes to the reservation must be disclosed and accepted before implementation.
28. Third-Party Providers and External Booking Platforms
Guests booking through VYBE Premier Rentals are subject to the terms accepted through the VYBE booking process.
Guests booking through external platforms may also be subject to the applicable platform’s terms.
Where conflicting terms exist, applicable law and the controlling booking agreement determine which terms govern.
29. Privacy and Communications
VYBE collects and processes reservation information to administer bookings, provide guest services, process payments, and communicate important reservation information.
Personal information is handled according to the applicable Privacy Policy.
Transactional communications may include reservation confirmations, payment notices, arrival instructions, and cancellation information.
Marketing communications, where applicable, are subject to separate consent requirements.
30. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Hawaii, except where mandatory law requires otherwise.
Guests and VYBE are encouraged to attempt good-faith resolution of disputes through direct communication.
Nothing in these Terms restricts access to courts, regulatory authorities, or other remedies that cannot legally be waived.
31. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the extent permitted by law.
An unenforceable provision shall not invalidate the agreement as a whole unless required by applicable law.
32. Changes to Terms and Conditions
VYBE may revise these Terms from time to time.
The version accepted at the time of reservation confirmation will generally govern that reservation, unless a subsequent modification is expressly agreed to or applicable law requires otherwise.
Updated Terms will be posted on the website with an effective date.
